Terms of Use

IMPORTANT PROVISIONS ON THE USE OF THIS WEBSITE

Use of this website is reserved for net-literate legal adults, whatever that means in your country and/or education system. We sadly also cannot guarantee or be held liable that this website or linked content (including ads) does not contain sensitive, distressing, or potentially traumatizing themes for someone visiting from the interwebs or stumbling over this page (we recommend the use of an ad and profanity filter or content control software at your discretion).

We did not make this decision with a light heart (sorry, not our choice, but we want to keep this project legally safe) and encourage everyone to actively participate in the discussion on free speech, internet censorship under the guise of morality, keeping vulnerable groups safe or fruitlessly trying to protect children from change (background information can be found e.g. at eff.org, quadrature du net, freiheitsrechte.org, noyb.eu and epicenter.works, relevant xkcd comics can be found here: Free Speech, SOPA, The Pace Of Modern Life).

By using this website, which includes accessing any information e.g. through browsing (visitor) and services provided (user), you agree that your actions do and will not be construed by your legal system and national rules as a situation wherein this website and project can be liable for any damages or breach of national and international rules of the parties involved (namely your legal norms and those of the admin of the website).

You further agree, that you immediately cease usage, if this is not the case and will not use the situation as the basis for any legal claim against this website.

You are especially not allowed to use this website, if

  • if you are using the information to collect data contrary to the content licenses
  • if you are using the information for LLM and machine learning applications, your mass collection may only be for free and open models (and only if the content licenses are respected) and never for models that are or might in the future be commercial or restricted - this provision is also applicable for derivative products
  • you have not educated yourself on the dangers of digital networks (see e.g. below) and have accepted the risks this usage may pose
  • if you are engaged in or connected to a legal dispute against this website or are supporting preparing one

If you still wish to bring a claim against this websites or related projects you agree to  Vienna, Austria (EU) as place of law and jurisdiction (Austrian Law; Vienna, Austria, EU;  LGZ). It will be further agreed, that

  • before initializing legal proceedings arbitration will be sought by all parties first directly and later at an organisation of the projects choice at place of jurisdiction .
  • cost of experts, reviewers or consultants for both parties during proceedings shall be borne by parties suing the project while allowing free choice for both parties.
  • alleged damages or settlement fees will be calculated and capped by Austrian Law and have to be proven and concrete, not estimated and general.
  • if alleged damages or settlement fees are calculated through estimates all damages exceeding the alleged sum up to the legal maximum will be agreed upon to be donated as a voluntary donation to the project after any resolution (legal or otherwise).
  • if process or proceedings are used to protract in any way, any and all costs, alleged damages or settlement fees will be agreed upon to be donated as a voluntary donation to the project after any resolution (legal or otherwise) or after one year of no relevant progress.
  • if criminal proceedings are brought and/or used as a tactic (e.g. in the sense of abusing process or to protract) or pretext to circumvent any protections and rules mentioned here (implicit and explicit), this will be reported at local, regional and/or (inter)national authorities. Any alleged damages or settlement fees will be agreed upon to be donated as a voluntary donation to the project after any resolution (legal or otherwise) or after one year of no relevant progress.

INFORMATION ON THE USE OF DIGITAL DATA NETWORKS

At this point, we would also like to expressly point out the many ways in which personal data can be protected in the digital space. As this topic has been the focus of public discussion since the beginning of digital communication and digital networks, there are a number of freely accessible teaching and learning resources and as this topic is also taught in schools using state-of-the-art technology, we also hope that our users will be aware of the problem and have a basic understanding of it - as is in their best interest when freely entering a digital space as responsible citizens.

As a startingpoint for further education we provide information below. All information is provided as is and should not be seen as legal advice or condoning a certain product or organisation.

Information on the safe use of the Internet (links lead to third-party providers - no liability):

We also strongly recommend the use of a VPN or the TOR browser. Various modern browsers also offer special plug-ins to prevent cookies and the reading of personal data. See for example:

Please also familiarize yourself with the ongoing debates and initiatives of stakeholders concerning security, privacy and data protection. Some relevant civil society initiatives that offer good introductions are eff.org, quadrature du net, freiheitsrechte.org, noyb.eu and epicenter.works.

EXTENDED SEVERABILITY CLAUSE (SALVATORISCHE KLAUSEL)

Should individual (partial) provisions be invalid, they shall be replaced by the best fitting possible similar legal provisions in case of doubt. The invalidity of a provision does not invalidate other provisions, in particular those relating to data protection and the use of this website.

GENERAL INFORMATION ON PERSONAL DATA COLLECTION

This website is committed to the protection of your personal data and respects your privacy. Therefore we do and in general will not collect any data. This is also why it is sadly not possible to freely sign up or log in, as only this is a safe and liability-reducing way for this website to navigate the legal realities. We have chosen simple html as a ways to further reduce attack surface - but we remain dependent on net-literate users for this to be effective (see above).
